Estate Litigation

Estate Litigation

There are various different ways in which estates wind up in litigation. Contests often arise with respect to the validity of a Will. Most commonly, this litigation is based on the allegation that a Will is either the product of undue influence or coercion or that it is an outright forgery, that it was revoked by the execution of a new Will or other act of the Testator, or that the Will was never properly executed in the first place thus rendering it invalid.

Litigation may also arise regarding the legality of a provision of a Will, the suitability of a nominated Executor or proposed Administrator to serve in those capacities, and the estate representative’s ability to account for their actions as fiduciary. Our office has a wealth of experience to draw upon in representing our clients in all manner of contested estate proceedings, and is known in particular for our ability to handle the most complex of such cases.
